PARTNER TERM'S & CONDITIONS

1. DEFINITIONS

1.1   “We” and “Us” shall be used as "PROTOMOTIVE TECHNOLOGIES PRIVATE LIMITED" having registered office at 15/169, Chandni Complex, Khariwad, Near Ice Factory, Nani Daman 396-210, including its employees, workers, service providers, owners as a provider of automotive service's.

1.2   “You” shall include any user who browse the website or application and is willing to partner with repair-it.

2. Registering as a Partner (Service Provider)

2.1    In order to benefit from all the features of Repair it available to Partners you will need to register with us. You will be asked to provide certain information about your business including your business name and contact details, services and pricing, working hours, Number of Employees, location details. You must ensure that the information provided by you while registration is correct, complete and not misleading. You should also inform us promptly of any changes to the information that you provide, by updating your details, in order that we may communicate with you effectively.

3. Provision of the Services to Partner

3.1    Following registration, we will make certain services available to you. The services will include the ability to include details of your business on repair-it platform, the ability to view or receive details of Customer Service bookings which have been posted by Customers and the ability to accept bookings and share service status updates with Customers. Full details of the services available to partners on our platform will be published on our Website & application from time to time.

3.2    We are continually seeking to develop and improve the services we offer and so we reserve the right, at our absolute discretion, to make changes to any part of the service without notice.

4. Our Responsibilities to you

4.1   We will provide Repair-it Service's to you using reasonable skill and care and in accordance with these Terms of Use. However, if you use The Services as a partner you acknowledge and agree that the services we provide are subject to the following limitations and disclaimers, You acknowledge and agree that we will enable potential partner's to register and get listed based on criteria which we (in our absolute discretion) may determine from time to time.

4.2   In addition you acknowledge that the number of Service bookings which may be posted or transmitted to a Partner in relation to any particular customer may be limited in number. Accordingly, we do not provide any guarantee that registering as a partner will result in you being invited to receive any particular volume of Service bookings, Nor can we guarantee that your use of Repair-it will result in you winning any work or any particular volumes or work.

4.3   You acknowledge and agree that we do not check or verify the details of any Service Bookings which are posted. We have asked all users to use Repair-it responsibly but cannot guarantee the accuracy, integrity or quality of any information which is posted by third parties.

4.4   By registering as a Partner you also understand and agree that Customers who have used your services will be able to provide Feedback and Ratings. We have asked all users to act responsibly, we do not actively monitor, check or verify Feedback which is posted. Accordingly, you acknowledge and agree that we shall not have any responsibility to you or liability to you for any feedback which is posted by any Customer and we will not usually become involved or intervene in complaints or disputes concerning feedback, although we reserve the right to do so in exceptional circumstances. You may, if you feel that Feedback is misleading or incorrect, contact us at +91 9016530651 or can mail us at admin@repair-it.in and we will investigate but we shall not be obligated to take any action.

5. Your Responsibilities

5.1   You agree to abide by the Terms of Use when using Repair-it, which we make available via online media such as Website, Application, WhatsApp & SMS.

5.2   You shall be solely responsible for checking and verifying the details of any service booking which is posted before you agree to undertake any work for a customer and for agreeing with the customer the terms and prices of services on which any work will be performed.

5.3   You shall be responsible for complying with all applicable laws and regulations in your dealings with customers and for the performance and quality of any work which you agree to undertake for any Customer.

5.4   Any additional work must be done only if the customer give an approval of the additional service's or parts.

5.5   It is mandatory for partner to provide all required details before adding a new service's or parts.

PLEASE NOTE :    By registering as a Partner and by using Repair-it you are agreeing to indemnify us and hold us harmless from any costs, losses or claims which may result from any information you submit or transmit via Repair-it or from any work which you agree to perform for any Customer.

6. REFUND AND CANCELLATION POLICY

6.1   No amount, partially or fully, of the advance on a booking cancelled by a customer on our website or app shall be transferred unless in the event where the customer cancels a booking via our app, 30 minutes prior to the scheduled appointment. In the event where the customer cancels 30 minutes prior to the scheduled appointment, the entire advance booking amount shall be transferred to your virtual wallet on our Application.

6.2   In the event of failed transactions due to any reason that may or may not be mentioned in these terms or double realisation of amount for the same order booking, the entire advance shall be transferred to your virtual wallet on our application.

6.3   In the event where our executive, support staff or admin cancels the booking due to any reason whatsoever that may or may not be covered under these terms, you shall receive the entire advance booking amount on your virtual wallet on our application. 7. INTELLECTUAL PROPERTY RIGHTS

7.1   We are the sole owners of the intellectual property rights including the website’s & application content, software & domain. This website & application is protected under the Copyright law and all such rights are reserved.

7.2   Our website & application may contain graphics, logos, icons, content with unique fonts and colour schemes and you do not have permission to use it without our explicit and written consent.

7.3   Your action of mentioning our location and tagging us in your stories, posts or any form of temporary or permanent content on any social media platform is the extent of the usage of our intellectual property rights.

8. Privacy Policy

8.1   Before you continue using our website or application, we advise you to read our privacy policy https://repair-it.in/privacy-policy regarding our user data collection. It will help you better understand our practices. The Website may display third-party advertisements with or without hyperlink. We disclaim any responsibility for the content displayed as well as the privacy policy and terms of use for the respective third-party website. Your access to these websites does not fall under our responsibilities and will be at your own risk.

8.2   We do not recommend, promote or endorse the products or services presented on the third-party websites. If you avail those services or purchase those products, we shall not be responsible for such purchase and you are recommended to do so at your own risk. When you avail our services, we recommend that you adhere to our house rules. This will make your stay comfortable and easier for us to host you. Your access to the website or application can be revoked at any point without any notice or explanation for the same.

9. DISPUTE RESOLUTION

9.1   In case of a dispute which isn’t resolved unanimously, the Parties shall resort to appointing a mediator, with mutual consent.

9.2   If the mediation attempt goes unsuccessful, the Parties shall appoint a sole arbitrator in accordance with the Arbitration and Conciliation Act, 1996.

9.3   The appointment of the arbitrator shall be mutually agreed upon by the Parties. The language of the arbitration may be English or Hindi, at the majority discretion of all the Partners. The Parties should follow the aforementioned steps before taking a dispute to the court.
